Acceptance of these terms
By using the NexiAgent website or services, you agree to these Terms of Service. If you do not agree, please do not use the service. These terms are provided by FirstLight Technologies, Lda., the company behind NexiAgent.
Our service
NexiAgent provides AI assistants that handle tasks such as answering customer messages, booking appointments, and following up with leads. We may improve, change, or add features over time.
Your account
You are responsible for keeping your login details safe and for everything that happens under your account. We recommend enabling two-factor authentication. Please provide accurate information and keep it up to date.
Acceptable use
You agree to use the service lawfully. You must not:
- Break the law or infringe the rights of third parties.
- Send spam or harmful, unlawful, or misleading content.
- Attempt to damage, overload, or gain unauthorised access to the service.
- Use the service to process data you have no right to use.
Plans and payment
Paid plans are billed in euros (EUR) at the prices shown at the time of subscription, and taxes may apply. Payments are processed securely by Stripe and PayPal. Subscriptions renew automatically unless cancelled before renewal.
For annual plans, you can request a refund within 14 days of purchase. Other amounts are non-refundable, to the extent permitted by law and without prejudice to your consumer rights.
Intellectual property
The NexiAgent platform, brand, and content belong to FirstLight Technologies, Lda. or its licensors. You keep ownership of the content and data you provide, and you grant us the limited rights we need to run the service for you.
Data processing
When we process personal data on your behalf (for example, your customers' data processed by the assistants), we act as your data processor under Article 28 of the GDPR, following your instructions. Business customers can request our Data Processing Agreement (DPA) through [email protected].
Confidentiality
Each party agrees to protect the other's confidential information and to use it only as needed to provide or use the service. This duty continues for three years after the relationship ends.
Warranties and AI outputs
We work hard to provide a reliable service, but it is provided "as is". AI assistants can make mistakes, so their output is not guaranteed to be accurate or suitable for every situation. You are responsible for reviewing important outputs before relying on them.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law, including mandatory consumer rights.
Indemnification
You agree to cover the reasonable losses we suffer if you use the service in breach of these terms or the law.
Term and termination
You can stop using the service at any time. We may suspend or terminate access in the event of a serious breach of these terms. When the service ends, the relevant sections of these terms continue to apply.
Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages, natural events, or actions of third parties.
Governing law
These terms are governed by the laws of Portugal and applicable European Union regulations.
Disputes
We will always try to resolve any issue amicably first. Any dispute that cannot be resolved will be submitted to the courts of Porto, Portugal, without affecting any mandatory consumer protection rights you may have.
Changes to these terms
We may update these terms from time to time. We will update the date above and, for important changes, let you know in advance where possible.
